General Terms and Conditions of DC Sprachschule Wien GmbH

1. Applicability

  1. These Terms and Conditions form the legally binding basis for any contractual relationship between DC Sprachschule Wien GmbH, FN 554209 p, Seitenstettengasse 5/37, A-1010 Wien (from here on DeutschClub Wien) and persons using their online German course services.

    The terms customers, course participants and consumers will be used equally for all such persons from here on.

  2. The current versions of both the Privacy Policy and the Mission Statement are valid parts of the Terms and Conditions. By entering into a contract, customers formally accept and agree to them.

2. Requirements for the language course

  1. Participants are using their own devices, which must be equipped with a working camera and microphone (PC, laptop, tablet, possibly a headset) as well as a stable internet connection. A smartphone is not sufficient for making optimal use of the full range of our services or participating in a course in a meaningful way.

  2. Online classes are taught via third-party service provider Zoom (Zoom Video Communication, Inc.). In order to use Zoom, an internet speed of at least 1.2 mbps (upload/download) for HD video is recommended. The installation of additional programmes is not necessary. Participants do not need to register, pay or give their credit card details. Participants agree to Zoom’s Privacy Policy (zoom.us/privacy-and-legal).

  3. A coursebook and any additional course materials are provided in digital form by DeutschClub Wien and are included in the course fees.

  4. In principle, any person aged 14 and over can participate in the courses (if they possess legal parental or guardian consent).

3. Enrolment

3.1. Enrolment in a language course

  1. Enrolments are considered and processed by arrival date. An enrolment will be counted as a reservation until 10 working days before the start of the course. Only after the course fee has arrived in full in the company account of DeutschClub Wien will the booking be confirmed and a place on the course guaranteed.

  2. A distinction will be made between first enrolment and subsequent enrolments.

  3. A first enrolment can be performed online using the form provided by DeutschClub Wien on their website (www.deutschclub.at).

  4. For a first enrolment, the following details have to be entered correctly: first and second name, address, date of birth and e-mail address. The company has to be notified immediately of any changes, either per e-mail or telephone.

  5. The enrolment can be performed for another person. The person performing the enrolment will be liable for the course fees.

  6. Only the person whose details are entered into the enrolment form can participate in the course.

  7. In order to assess their language level, customers are obliged to do a free assessment test before the start of their first course.

  8. If an enrolment has been performed in the past, it is possible to enrol for subsequent courses via the website (www.deutschclub.at), per e-mail or telephone. There is no automatic reservation of a place in subsequent courses. If customers have not participated in a language course for six months or more, they will be asked to do another assessment test.

  9. At the end of the registration process, the invoice will be sent by the DeutschClub Wien via email. After payment has been received in full (IBAN: AT79 2011 1843 9313 3200; BIC: GIBAATWWXXX), the corresponding invoice will be valid as a legally binding booking confirmation. From that point, a customer is booked on the course.

3.2. Assessment test

  1. In order to determine the most suitable course level, each prospective participant has to personally perform a free level test.

  2. Optionally, an online test can be done in advance on external websites (online assessment).

  3. Please contact us for your personal level test (online assesment interview).

  4. The personal level test will be held via the third-party service provider Zoom at a suitable time. A device with functioning camera and microphone will be required (PC, android phone).

4. Payment

  1. The course fee has to have reached the bank account of DeutschClub Wien in full before the start of the course. If the course fee does not arrive in full or not until after the end of the reservation period, a place on the course cannot be guaranteed, unless otherwise agreed in writing with DeutschClub Wien.

  2. Payments can be made via bank transfer, PayPal, VISA or Mastercard. Cash payments on site are not possible.

  3. The invoice and further information regarding the payment modalities will be sent by email. Bank transfers should be made out to the following account:

5. Cancellation Policy

  1. Courses will be run with a minimum of 5 participants. If this minimum number is not reached, DeutschClub Wien reserves the right to cancel the course. In that case, any payments made will be refunded in full or can be used to book another course if the customer agrees to do so. Instead of cancelling the course, DeutschClub Wien may change the course dates, shorten the course (fewer TUs with the same number of course days) or offer the course to a smaller group at a higher price. In those cases, customers have the options of agreeing to join the course under those changed conditions, change their booking at no extra cost or withdraw from the contract.

  2. In accordance with § 11 of the Austrian Distance Selling Act (FAGG), customers have the right to withdraw from a contract within fourteen days without giving reasons.   3. According to § 18 section 1 FAGG, customers do not have the right of withdrawal for:

    • Services provided in connection with leisure activities, if the contract specifies a time or period of time to enable the company to fulfil the contract.
    • Therefore, customers explicitly confirm that they are aware of losing the right of withdrawal from a contract which has been fulfilled if a service started before the end of the fourteen-day withdrawal period and was subsequently provided in full.
  4. Should a customer require a service (one-to-one lessons, in-company tuition) to start during the withdrawal period, a proportional payment for all tuition received up to the time of the declaration of withdrawal by the customer will be due.

  5. Customers can cancel a course in writing after the statutory withdrawal period has expired up to 14 days before the intended start date of the course. In that case, customers will be charged an administrative fee of €30.00 plus bank fees. If a customer cancels a course less than 7 days before the intended start date, the full amount of the course fee will have to be paid. Cancellations are only valid after confirmation by DeutschClub Wien.

  6. Any fees already paid can be transferred to a different course at DeutschClub Wien or to a different person at no extra cost up to 7 days before the intended start date of the course. After this point, customers will be charged an administrative fee of €30.00 plus bank fees.

  7. From the second change of booking onwards, customers will be charged an administrative fee of €40.00 plus bank fees.

  8. No refunds will be made in the event of sporadic participation in a language course and extending or postponing the course will not be possible.

  9. Customers are not entitled to being taught by a specific teacher. A teacher change does not give customers the right to withdraw from the contract.

  10. If course sessions or parts of sessions cannot be carried out by DeutschClub Wien for technical reasons, they will be provided accordingly at a later date. A refund is not possible.

  11. If a customer cannot participate in a session for technical reasons, the service will be seen as rendered.

  12. In the event of force majeure, customers are not entitled to any refunds.

  13. Any cancellations of or time changes to one-to-one lessons or in-company courses have to be submitted (in writing or per telephone) to the office of DeutschClub Wien at least 24 hours before the start of the lesson, otherwise customers will be charged the full fee for the agreed time.

6. Course conditions

  1. The course provider is DeutschClub Wien. One teaching unit (TU) consists of 45 minutes.

  2. Breaks are not counted as lesson time.

  3. There is no teaching on Austrian public holidays and courses are planned accordingly. Please see the course programme for course dates and the total numbers of teaching units.

  4. If there is sufficient demand, DeutschClub Wien reserves the right to offer additional course dates.

  5. Participants are not permitted to record, save or pass on recordings (neither audio nor video) of online lessons or any personal details learned during such lessons.

  6. At the end of the course, participants will receive a certificate of attendance at no extra cost if they have attended a minimum of 75% of the sessions. Participants whose attendance is lower will not receive a certificate of attendance even if they have paid for the course.

7. Exclusion from the course by DeutschClub Wien

  1. Should a customer behave in a manner that constitutes a serious breach of contract and/or obstructs the running of the course, DeutschClub Wien has the right to issue a written warning. If the customer continues to disregard the issues specified in such a warning, the customer can be excluded from the course without compensation. In that case, the course fee will not be refunded.

8. Liability

  1. All available information has been compiled by DeutschClub Wien with all due diligence. However, no liability is assumed for its accuracy, currentness or completeness unless DeutschClub Wien is found to have acted with deliberate intent or culpable negligence.

  2. DeutschClub Wien cannot be held accountable for reaching specific course- or learning goals.

  3. Participation in excursions is at one’s own risk.

  4. Customers are responsible for any damage they cause. The provider will not be liable for any damage, including injuries. DeutschClub Wien does not provide accident or health insurance. Legal guardians are liable for minors.

9. Other

  1. DeutschClub Wien reserves the right to change their policy, programme, prices or these Terms and Conditions without prior announcement. This will not affect existing contracts. When entering into a new contract (e.g. when enrolling in a subsequent course), it is always the current conditions which will come into effect.

  2. Severability clause: Should any item of these Terms and Conditions be or become invalid or void, the remaining items will be unaffected.

  4. Barring any other legally compelling jurisdiction, the court of jurisdiction of DC Sprachschule Wien GmbH is in Vienna, as is their registered office. § 14 of the most recent version of the Consumer Protection Act (KSchG) applies to customers who are consumers.
